Hopewell Township Settles with Landowners in Affordable Housing Ligitation, Scotch Road Included

Hopewell Township entered into three resolutions on Monday night authorizing the settlement with three separate Township landowners and/or developers in the affordable housing litigation. The resolution states that, “several property owners have intervened in the proceeding and expressed an interest in construction of affordable housing during the third round while others have expressed an interest and commitment to construct affordable housing but have not formally intervened,” and that the property owners (listed below with names and locations) and have committed to produce a “substantial amount of affordable housing on the property by intervening in the proceedings.

Based on discussions in executive session on Monday night, the Township approved three Letter Settlement Agreements and Addendum to confirm the Township’s third round fair share obligation. The resolution states that the three landowner/developers have provided the “design concept for the proposed inclusionary affordable housing project to be undertaken, and the number of affordable housing units/credits that will be produced.”

The properties involved in the litigation and resolutions are:

  • CF Hopewell CC&L LLC (“CF Hopewell”) owns and controls property on both sides of Scotch Road;
  • Albert Enourato and US Home Corporation (d/b/a “Lennar“) which owns 11.70 acres of property in Hopewell Township proximate to Route 31 that are shown and designated on the Tax Map as Block 78, Lot 17 (just north of Stop and Shop on RT 31);
  • Woodmont Properties, LLC and Federal City Raod, LLC (collectively “Woodmont”)(however referred by the Township in proceedings as “Klockner“) which owns approximately 22 acres of land in Hopewell Township on Federal City Road.
