An Objection and Request for Denial of Application of the Hopewell 57 Development Application

To the Editor and Members of the Hopewell Borough Planning Board:

I respectfully submit this correspondence as a formal objection to the pending application submitted by Jeffrey Albert and Princewood Properties relating to the proposed Hopewell 57 development project currently before the Hopewell Borough Planning Board.

While the governing body may have previously adopted ordinances affecting zoning parameters applicable to this site, it remains the independent legal obligation of the Planning Board under the New Jersey Municipal Land Use Law (“MLUL”), N.J.S.A. 40:55D-1 et seq., to determine whether the applicant has satisfied all statutory, ordinance-based, engineering, environmental, circulation, drainage, parking, and public safety standards required for approval.

It is my position that the application, as presently submitted and testified to, should be denied for the following reasons:

1. Insufficient Proofs and Deficiencies in the Evidentiary Record

The current application raises substantial concerns regarding the sufficiency, accuracy, and completeness of the supporting testimony and documentation presented by the applicant and its experts.

Specifically, the application appears to lack adequately supported and independently validated analyses relating to traffic circulation impacts, vehicular access and congestion, on-site and off-site parking adequacy, drainage and stormwater management, environmental impacts and mitigation responsibilities, and public safety implications associated with increased density and vehicular volume.

Additionally, portions of the parking and projected student-generation analyses appear to rely upon materials that do not constitute independent governmental or peer-reviewed planning studies. Rather, these materials appear to consist of industry-sponsored white papers and surveys commissioned by or derived from real estate development and property management interests, rather than neutral municipal planning authorities or independently verified public-sector research.

To the extent these materials were relied upon as substantive planning evidence, significant concerns exist regarding their objectivity, methodology, applicability to Hopewell Borough, and evidentiary reliability.

2. Failure to Adequately Address Environmental and Drainage Concerns

The record presently before the Board raises substantial unresolved concerns regarding drainage, stormwater impacts, environmental consequences, and the long-term effects of increased impervious coverage and development intensity on the surrounding neighborhood and community infrastructure.

Under the MLUL, the Board is expressly permitted to consider impacts upon public health, safety, welfare, circulation, environmental conditions, and municipal infrastructure when evaluating site plan and subdivision applications.

3. Legitimate Public Health, Safety, Parking, and Welfare Concerns

This application presents legitimate and substantial concerns regarding the health, safety, and welfare of the Hopewell Borough community.

Those concerns include, but are not limited to:
• Increased traffic volume and circulation conflicts;
• Inadequate parking infrastructure and overflow parking impacts;
• Pedestrian safety concerns;
• Emergency vehicle accessibility concerns;
• Drainage and stormwater impacts;
• Increased density without corresponding infrastructure support; and
• Cumulative impacts on neighborhood character and municipal functionality.

New Jersey courts have consistently held that while Planning Boards may not deny compliant applications based solely upon generalized public opposition, they retain the authority and responsibility to deny applications where substantial evidence demonstrates that the application fails to adequately protect the public good, public safety, or welfare, or where material deficiencies remain unresolved within the evidentiary record.

Based upon the foregoing concerns and deficiencies, I respectfully request that the Hopewell Borough Planning Board deny the pending application unless and until the applicant can provide complete, independently supported, and legally sufficient proofs addressing these substantial issues.
